Capital One Settles with Influencers Over Affiliate Commission Dispute

The long-running clash between social media creators and Capital One’s affiliate arm, COF, has reached what feels like a truce. Capital One’s COF quietly announced a tentative settlement with dozens of influencers who said the free browser extension, Capital One Shopping, rerouted commissions meant for them. A settlement notice was filed in Alexandria, Virginia, federal court, and preliminary approval is expected by November 17.

A Long-Awaited Settlement

In simple terms, the creators claimed that their referral links were overwritten at checkout, so Capital One Shopping looked like the source of traffic. Meanwhile, influencers watched commissions disappear into the bank’s account.

Extension or Hijacker?

Affiliate marketing works on trust: you click, you buy, the creator earns. But here, over ten million users hunting for discounts might have unknowingly triggered the extension to tag Capital One as the referrer.

What the Creators Claimed

  • Unjust enrichment: Were affiliate fees wrongfully diverted?
  • Contract interference: Did the extension override tracking codes?
  • Computer Fraud and Abuse Act breaches: Is this a digital trespass?

Judge’s Decision and Capital One’s Position

Back in June 2025, U.S. District Judge Anthony Trenga found that influencers had a believable case on the core allegations, although he dismissed one conversion claim and four state-level counts. That green light meant the lawsuit could move toward settlement rather than outright dismissal.

In a carefully worded statement, the company refused to admit any liability. It insisted the tool adheres to industry norms and won’t alter the shopping experience for users. Advertising partners, they emphasize, remain aligned.

This isn’t COF’s only headline. Earlier this year, Capital One sued the FDIC over a $474.1 million special assessment tied to bank failures in 2023. And in May, it agreed to pay $425 million over allegations of misleading online savings customers.
